1. Operator Disclosure
Acorn America (AcornAmerica.com) is not a lender, loan broker, or agent for any lender or loan broker. We are a marketing lead generator and a matching service. We do not make credit decisions, originate loans, or make short-term cash loans. We do not charge fees to you for this service.
Our service connects consumers who are looking for financial assistance with independent third-party lenders and lending partners in our network. Submitting your information via our online forms does not guarantee that you will be approved for a loan or that you will be connected with a lender.
2. Credit Check & Consumer Report Authorization
By submitting your information through Acorn America, you acknowledge, agree, and authorize that:
- You are establishing a business relationship with Acorn America and its network of partners.
- Participating lenders may verify your social security number, driver’s license number, or other federal or state identification.
- Lenders may review your information against national databases (such as Equifax, TransUnion, Experian, Teletrack, DP Bureau, or others) to determine your creditworthiness, credit standing, and/or credit capacity.
Lenders may perform soft or hard credit pulls, which may impact your credit score. Acorn America does not perform these checks; they are conducted solely by the third-party lenders with whom you may be connected.
3. APR, Fees, and Rate Information
Acorn America is not a lender and does not have the ability to determine or quote the exact Annual Percentage Rate (APR) you will be charged. The APR is determined solely by the lender you are connected with and is based on your credit score, income, credit history, and other factors.
Representative APR Range: While rates vary by lender and state regulations, personal loan APRs typically range from 5.99% to 35.99%. For short-term or payday loans, APRs may be significantly higher.
Lenders are legally required under the Truth in Lending Act (TILA) to present you with the loan terms, APR, fees, and repayment schedule before you execute the loan agreement. You are under no obligation to accept these terms. If you find the terms unacceptable, you may exit the process at any time before signing.
4. State Availability & Compliance
Our services are not available in all states. Residents of Arkansas, New York, Vermont, and West Virginia may not be eligible to use this service due to state specific regulations. Availability of loan products is subject to change without notice based on state laws and lender availability.
5. Implications of Late or Non-Payment
Accepting a loan is a serious financial responsibility. You should only borrow what you can afford to repay. Late or non-payment of your loan may result in:
- Additional fees or financial charges.
- Collection activities by the lender or a third-party agency.
- Negative reports to consumer reporting agencies, which may lower your credit score.
Acorn America does not control the collection actions of third-party lenders. Please review your lender's specific policy regarding late payments, renewal policies, and loan extensions.
6. Marketing Communications (TCPA Consent)
By submitting your information, you provide express written consent to be contacted by Acorn America, our lending partners, and third-party marketing partners via telephone, SMS/text message, email, or automated dialing systems, even if your telephone number is listed on a corporate, state, or federal Do Not Call registry. You may opt-out of these communications at any time.
